How to Get Court Records
Every trial-level record in Gaston County answers to one office. The Clerk of Superior Court holds Superior Court files, District Court files, and the county's magistrate, estate, and special-proceeding records. So the request starts with a product choice. Do you want a public Case Summary? A plain copy of a document? A certificate under seal, an exemplification, a transcript of judgment, a hearing transcript, or an audio recording? Each is a different product. Each has its own channel and its own limits.
- Use North Carolina eCourts Portal Smart Search to identify a public case number, case type, parties, and the particular event or document needed. Portal is useful for locating a public record, but it is not the official court record.
- For a public document image, see whether Portal makes that single image available. If it is not present, use the Gaston courthouse public terminal or inspect the public paper or electronic file through the clerk.
- Contact the Gaston Clerk of Superior Court by phone at (704) 852-3100 or visit the clerk at the courthouse. Give the county, case number if known, case type, parties or date if known, and the exact document or certification requested.
- Confirm public access, copy charges, certification, and payment with the clerk before sending money. The official Gaston payment page documents court-payment routes, but the research did not find a general certified-copy mail form, email route, fax route, or turnaround promise.
- For a Judicial Branch administrative record rather than a court case file, use the NCAOC public-record request route. Its own instructions direct case-document and case-information requests to the court and clerk.
Online, the state eCourts Portal for North Carolina is the search layer. Gaston access runs locally through four doors. Use the clerk terminal, the paper-file process, the counter, or the phone. One caution. A mailing route set up for court payments is not a general copy-request service. If you need a public copy by mail, confirm the method with the clerk first.
Gaston County Record Request Details
Details make a Gaston County request work. Give the county, the case number if you have it, and party or citation information. Add the case type and the exact document or event you need. With that, the Gaston County clerk can tell a public Case Summary from an ordinary copy. The same goes for a certificate under seal, a transcript of judgment, a hearing transcript, or an audio request. Those Gaston County products carry different access rules and different fees.
No general certified-copy web form or email route for Gaston County is published. No identity rule or turnaround promise exists either. Confirm the actual request method with the clerk. Do not assume a court-payment mailing route will handle documents.
Gaston Case Summaries and Clerk Copies
Name the product and Gaston County records get much simpler. The Portal labels its public docket timeline the Case Summary. It is also called the Register of Actions. It draws on the clerk's official record. It is not the official record itself. A public filed image, where one exists, is the actual uploaded document. A certificate under seal or certified copy comes straight from the clerk. That document does legal work a home printout never will.
| Gaston record product | Best channel | Key limit |
|---|---|---|
| Case Summary / Register of Actions | Portal Smart Search or courthouse public terminal. | Public case-history summary, not an official clerk certificate. |
| Filed document or image | Portal when a public image is available, otherwise clerk file. | Images can be unavailable, restricted, or downloadable only one at a time. |
| Certificate under seal or certified-copy product | Gaston Clerk of Superior Court. | Access, current total, and correct certification must be confirmed with the clerk. |
| Transcript or audio recording | Court reporter for transcript; clerk for an available recording. | A transcript is not the docket, and recording availability is limited. |
Here is the trap to avoid. An online Case Summary can identify a judgment or an order, but printing it out does not make it a clerk-certified judgment. Find the public case online first. Then ask the Gaston Clerk for the record product you actually need.
Note: A printed Case Summary shows public history. It does not create a certified Gaston County court record.
Types of Court Records
One clerk structure covers all trial-level Gaston County court records. The court division still shifts with the case type. Whether a file is public depends on that file and on legal restrictions. Portal's documented categories run from criminal and infraction matters to Civil General, Civil Magistrate, estates, and special proceedings. Family-related cases and more are covered too. Tie your request to the correct case. A generic ask for a background file will not get you there.
- Public Case Summaries or Registers of Actions that show permitted docket entries, events, hearings, dispositions, and related case information.
- Public filed pleadings, orders, judgments, and document images when they are available through Portal or the clerk file.
- Criminal, infraction, civil, family, estate, special-proceeding, and magistrate records kept through the Gaston Clerk's unified record system.
- Certificates under seal, exemplifications, and transcripts of judgment prepared as clerk-record products when available.
- Hearing transcripts from the reporter or available audio recordings requested through the appropriate court-record process.
Discovery and similar case material is not a public download by default. A public case summary is an index to events and record access. It does not promise that everything discussed in a hearing sits online.
Gaston County Clerk Record Custody
The Clerk of Superior Court in Gaston County keeps the local record. That covers Gaston County Superior Court and District Court files. Magistrate, estate, and special-proceeding records sit there too. A case assignment never creates a new county clerk. Need to verify a public document? The Gaston County clerk route is the right door for that or for any certified product.
Portal information for Gaston County is great for finding the exact file. But when an official copy is needed, the clerk's record controls. This distinction matters. It keeps a Gaston County case-file question from landing at a city office. It also keeps such questions out of the state administrative-record request channel.
Gaston Clerk Terminal and Paper Files
When the online record falls short, go to the Gaston courthouse. The Judicial Branch says public self-service terminals in clerk offices provide permitted criminal case information. They give the equivalent access route for civil, special-proceeding, and estate material. Public paper files may be inspected at the clerk office in the county where the case sits. Copies can be made for a fee.
The working record location for Gaston County is the Gaston County Courthouse, 325 Dr. Martin Luther King Jr. Way, Suite 1004, Gastonia, NC 28052. Published hours run weekdays from 8:30 a.m. to 5:00 p.m. Identify the exact event or document first. Use Portal or the terminal before asking for a file. Staff will not run an instant search for you, and restricted material stays off the public terminal. No fixed fulfillment time applies to copy requests.
Source: The Judicial Branch court-records instructions describe the clerk-terminal, file-inspection, copy, transcript, and audio routes.
For a Gaston County court record, the order is simple: try the Portal first, then the courthouse terminal or public file. The Clerk of Superior Court handles official copies and holds the underlying court records that back up that whole sequence.
What a Court Record Contains
A Case Summary helps you pull up a Gaston County court record fast. It names the case. It also lists what has happened in it. What follows covers the Portal and file functions that actually exist. It is not a promise that every field or document is public in every case. Sealed, confidential, juvenile, and other protected matters follow a different access rule.
| Case identity | Case number, case type, case status, filing information, and public assignment information. |
|---|---|
| Parties and cause | Public party information and, for applicable civil, family, probate, or mental-health matters, the cause of action. |
| Register entries | The chronological Case Summary events that show docketed filings, hearings, transfers, orders, and disposition-related activity. |
| Hearings and disposition | Hearing information and the recorded result or status, which should be read with surrounding events. |
| Financials | Financial information where applicable, with updates following clerk entry in Odyssey. |
| Documents | Public uploaded images when available, plus the clerk's underlying paper or electronic file subject to access rules. |
| Protected material | Restricted case types, sealed or expunged records, and protected identifiers are excluded from public Portal access. |
Public does not mean certified. A plain copy from a Gaston County court record is fine for reading, but it carries no seal. Need the official version? Give the clerk the case number and the exact document you want, not a vague request for the whole file.
Gaston Audio and Transcript Record Routes
A hearing transcript is a word-for-word typed record. A reporter who sat through the proceeding prepares it, or types it up from a recording. It is not the same thing as the Case Summary on the docket. It is not the clerk's transcript of judgment either. Reporters set their own rates. So for a transcript outside an appeal you contact the reporter directly and pay that person. The clerk is a separate route. If a proceeding was recorded and access is allowed, you can ask the clerk for the audio. Form AOC-G-114 covers a nonconfidential recording. AOC-G-115 is the form to move for permission to copy a confidential one. If an audio copy can be produced, the actual CD cost applies.
Not every hearing gets recorded. Criminal District Court proceedings are not recorded at all unless a judge orders it. Pleas in H/I felonies are excepted. So a Gaston County transcript request can come back empty simply because no recording exists. That is not a sign the docket search failed to find the case.
Note: A transcript of judgment is a clerk record with its own published fee. It is not a hearing transcript.
Certified Copies and Fees
Gaston County copy charges start with the state's published miscellaneous-fee chart. That chart splits copy preparation from the certificate under seal, which are two separate charges. Before sending payment, confirm the current total and the certification product with the clerk. This matters for a multi-page court record or more than one seal. The clerk's office publishes no separate Gaston general-copy price sheet. There is no general certified-copy mail form either.
| Gaston court record item | Published amount |
|---|---|
| Preparation of copies, first page of each document | $2.00 |
| Each additional page or fraction | $0.25 |
| Certificate under seal | $3.00 |
| Exemplification of records | $10.00 |
| Preparation and docketing of transcript of judgment | $10.00 |
| Nonconfidential audio recording CD | Actual cost if available |

Start by naming the exact Gaston County record you need. Then ask the clerk to confirm the cost and the certification before you pay.
Gaston County Has No General Copy Form
Gaston County publishes no single general form for certified copies of court records. It does offer two forms for recorded hearing audio. AOC-G-114 covers a request for a nonconfidential recording. AOC-G-115 covers a confidential proceeding, which needs court permission first. Neither form replaces a plain inquiry to the Gaston County clerk for a public docket or a filed document.
Want a certificate under seal, an ordinary copy, an exemplification, or a transcript of judgment? Name the case and the product you want. The clerk can then confirm access, the current charge, and how to pay.
Older Gaston Records After Odyssey
Gaston County moved onto Enterprise Justice, called Odyssey, on October 13, 2025. Portal is the statewide public system now. But older material may not all be online with the same coverage. Search Portal first. If the entry or image is missing, try the Gaston courthouse terminal or the public paper-file process. Still stuck? Contact the clerk about the older file.
A gap online does not mean the record was destroyed or microfilmed. Gaston's county seat moved from Dallas to Gastonia in 1911. The courthouse was rebuilt after an earlier fire. None of that history proves any particular court-record series was lost. The reliable move is simply to ask the clerk about the file you need.
One more Portal quirk deserves note. A public image can be too large. It then returns Error Code 141011. The Portal FAQ says to contact the clerk office. The clerk can split the document into smaller files. That direct route is the right fix for any public-image problem.
Public Access and Sealed Records
Access to Gaston County court records rests on the clerk's statutory record-keeping and inspection duties, the North Carolina Public Records Act, and any law or court order that restricts particular material. Portal is a convenience for public case types. It is not a way around a sealed, expunged, juvenile, confidential, or protected record. Registering for Portal changes nothing. A sealed or expunged record simply no longer appears online.
Key North Carolina rules:
N.C. Gen. Stat. § 7A-109 assigns clerk record keeping and permits public inspection during regular office hours unless access is prohibited by law.
N.C. Gen. Stat. § 7A-276.1 limits broad restrictions on reporting open-court proceedings and public records, but it does not make every file public.
N.C. Gen. Stat. § 132-1.4(k) identifies certain criminal documents as public unless a court order seals the particular record.
The official clerk-record access statute sets the rules the Gaston County Clerk of Superior Court follows when the public asks to inspect court records.
Roles stay clear under that law. A portal can point you to a public Gaston County docket entry, yet the Clerk of Superior Court keeps the official court file and governs its inspection.
Gaston County Remote Data Access
The Judicial Branch Remote Public Access Program is a different animal from a Gaston County court docket search. It exists to license bulk criminal and civil court data to organizations. It does not hand one person a single case. Gaston County publishes no subscription price for it. If you just need one case, skip it. Use Portal, the courthouse terminal, or the Clerk of Superior Court. That yields a normal Gaston County case lookup.
The state public-record request page also has a narrow job. It covers existing Judicial Branch administrative records only. Agencies are not required to build or compile a record that does not exist. It does not put NCAOC in charge of Gaston court files. Do you need a case document, a certified copy, or case information? The local clerk route remains the right one. That is true for any Gaston County court records request, big or small.
Note: A bulk-data license and an individual Gaston County court-record request are separate channels. They have different custodians and different purposes.
